Agreement to these terms

These Terms of Use govern your access to and use of Luma Smile, including the iOS app, website, support, subscriptions, and optional AI product evaluation. By downloading, accessing, subscribing to, or using Luma Smile, you agree to these terms. If you do not agree, do not use the app.

End User License Agreement

Apple's Standard End User License Agreement applies to your use of the Luma Smile iOS app. These Terms of Use supplement that license. If there is a direct conflict, Apple's required terms control to the extent required for App Store distribution.

What Luma Smile does

Luma Smile is a personal oral-care companion for habit tracking, progress photos, dentist appointment reminders, product logs, and educational product summaries. The app is intended for personal, non-commercial use and is designed to help you organize your routine, not to replace professional care.

No medical advice

Luma Smile does not provide diagnosis, treatment, prevention, cure, medical advice, dental advice, or emergency services. Scores, reminders, lessons, product summaries, and recommendations are informational and educational only. They are not a substitute for a dentist, physician, pharmacist, or other qualified healthcare professional.

Always consult a dentist or qualified professional for pain, sensitivity, bleeding, gum issues, injuries, whitening concerns, orthodontic questions, medication interactions, product allergies, children's dental care, or any medical or dental condition. Do not ignore professional advice or delay treatment because of information shown in Luma Smile.

AI-generated content

Product ratings, summaries, and recommendations may be generated using artificial intelligence based on the product name, brand, notes, and optional product photo you provide. AI output may be inaccurate, incomplete, outdated, or unsuitable for your individual situation. Packaging, ingredients, warnings, and claims may be unreadable or interpreted incorrectly.

You are responsible for reviewing product labels, following manufacturer instructions, checking ingredients and warnings, and consulting a professional when needed. You should not rely on AI-generated output as the sole basis for purchasing, using, combining, overusing, or discontinuing any dental product.

Your content and responsibilities

You are responsible for the information, notes, photos, product details, and support messages you provide. You represent that you have the rights needed to upload or use any content you submit and that your content does not violate law, privacy rights, intellectual property rights, or these terms.

You grant Luma Smile a limited license to process your submitted content only as needed to provide the app features you request, including storing local entries, generating optional AI product evaluations, operating support, maintaining security, and complying with law.

Subscriptions and billing

Luma Smile may offer paid subscriptions or premium features through Apple in-app purchases. Prices, trial availability, renewal periods, and included features may vary by country, storefront, offer, and App Store settings. Payment is charged by Apple to your Apple account when you confirm purchase.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period, or as otherwise stated by Apple for your region. You can manage or cancel subscriptions in your Apple account settings. Refunds, chargebacks, taxes, billing errors, and payment disputes are handled under Apple's App Store rules and applicable law.

We may use RevenueCat to manage subscription status and unlock paid access. Premium features may require an active subscription, network access, App Store availability, and successful entitlement verification.

Acceptable use

You agree not to misuse Luma Smile or its services. For example, you must not:

• Use the app for emergency, diagnostic, clinical, regulated medical, or professional dental decision-making.
• Submit unlawful, harmful, misleading, infringing, or privacy-invasive content.
• Upload images or information about another person without appropriate permission.
• Attempt to reverse engineer, scrape, overload, bypass limits, interfere with, or compromise the app, API, subscriptions, or security controls.
• Use AI product evaluation to generate medical instructions, unsafe product usage, or deceptive claims.
• Use the app in violation of applicable laws, platform rules, or third-party rights.

Accounts, access, and device requirements

Some features depend on your device, iOS version, App Store availability, internet connection, notification permissions, camera or photo access, Apple account, subscription status, and third-party services. You are responsible for maintaining your device, account credentials, backups, permissions, and network connection.

Changes to the app

We may add, change, suspend, limit, or discontinue features, subscriptions, AI models, usage limits, content, pricing, availability, and support options. We may release updates that are required for security, compatibility, legal compliance, or continued use of the app.

Intellectual property

Luma Smile, including its design, text, software, icons, branding, graphics, and other materials, is owned by or licensed to Luma Smile and is protected by intellectual property laws. These terms grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app as permitted by these terms and applicable App Store rules.

Third-party services

Luma Smile may rely on third-party services such as Apple, RevenueCat, OpenAI, hosting providers, and email providers. Those services are governed by their own terms and privacy policies. We are not responsible for third-party services outside our control, but we use them to provide app distribution, purchases, AI evaluation, hosting, and support.

Privacy

Our Privacy Policy explains how information is processed when you use Luma Smile. By using the app, you acknowledge that information will be processed as described there, including local storage, optional AI product evaluation, purchase processing, support communications, and website operation.

Disclaimers

Luma Smile is provided "as is" and "as available" to the maximum extent permitted by law. We do not guarantee that the app will be uninterrupted, secure, error-free, medically accurate, suitable for your needs, available in every location, or compatible with every device or operating system. Routine scores, reminders, progress tracking, and AI summaries are convenience features and may contain errors.

Limitation of liability

To the maximum extent permitted by law, Luma Smile and its developers, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, goodwill, health outcomes, or business opportunities arising from or related to your use of the app. Our total liability for any claim will be limited to the amount you paid for Luma Smile in the twelve months before the event giving rise to the claim, unless applicable law requires a greater amount.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Luma Smile and its developers, suppliers, and service providers from claims, damages, liabilities, losses, and expenses arising from your misuse of the app, your content, your violation of these terms, or your violation of law or third-party rights.

Termination

You may stop using Luma Smile at any time. We may suspend or terminate access to features if you violate these terms, create risk or legal exposure, misuse the app, or where continued access is no longer commercially, technically, or legally feasible. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, indemnity, and dispute terms.

Governing law and disputes

These terms are governed by the laws applicable in the jurisdiction where the Luma Smile developer is established, except where consumer protection laws in your location require otherwise. You and Luma Smile agree to try to resolve disputes informally first by contacting futureyou.support@gmail.com. Nothing in these terms limits rights you may have under mandatory consumer protection law.

Changes to these terms

We may update these terms as the app, subscriptions, AI features, business needs, or legal requirements change. The updated version will be posted on this page with a new "Last updated" date. Continued use of Luma Smile after changes become effective means you accept the updated terms, except where additional notice or consent is required by law.
